Terms of Use
Effective August 26, 2026
The rules, purchase terms, and important boundaries that apply when you use Forty. These Terms supplement Apple's Standard EULA.
Acceptance and effective date
These supplemental Terms of Use apply from August 26, 2026. By downloading, purchasing, or using Forty, you agree to these Terms and Apple's applicable terms. If you do not agree, do not use Forty.
Operator
Forty is provided by Marcus CADASSE, Entrepreneur individuel established in France. Contact marcuscadasse@gmail.com for product or legal questions.
Age and availability
You must be 18 or older to use Forty. The current version is offered for personal use in the United States through Apple's App Store. Availability may change where required by law, platform rules, or operational constraints.
Apple Standard EULA
Apple's Standard EULA governs the license to the iOS app. These Terms supplement and do not replace it. If these Terms conflict with mandatory Apple license terms, the applicable Apple terms control. Read the Apple Standard EULA and Media Services Terms.
Permission to use Forty
Subject to these Terms and Apple's rules, Forty grants you a personal, limited, non-transferable, non-sublicensable, and revocable permission to use the app on Apple devices you own or control for your own lawful personal purposes.
Personal-growth and faith content
Forty offers Christian reflections, scripture, exercises, reminders, and habit-support tools for personal growth. Christian traditions and individual circumstances differ. The content is general information, not a statement about your worth, faith, diagnosis, or likelihood of a particular result. Forty does not guarantee an outcome.
No professional or emergency relationship
Forty is not medical care, psychotherapy, addiction treatment, pastoral counseling, or emergency care. Using the app does not create a doctor-patient, therapist-client, counselor-client, clergy-parishioner, or other professional relationship. Forty is not an emergency service and must not be relied on for immediate safety needs.
Your responsibility
You remain responsible for your decisions, device security, Apple account, and use of the app. Seek a qualified health professional, licensed counselor, trusted faith leader, or other appropriate support when your circumstances call for it. In immediate danger in the United States, call 911. For emotional distress or crisis support, call or text 988.
Annual and lifetime purchases
Forty may offer an automatically renewing annual subscription and a one-time lifetime purchase. The App Store displays the price, currency, included access, and current offer before you confirm. Taxes and localized terms may vary.
A lifetime purchase provides access to the version and premium features Forty continues to make available under that product. It does not promise perpetual operation of every feature, compatibility with every future device, or cloud storage of your progress.
Trial eligibility
The annual product may include a three-day introductory trial for eligible users. Apple determines trial eligibility based on your App Store account and offer history. A trial is not available to every user. The purchase screen shown by Apple is authoritative before confirmation.
Automatic renewal and cancellation
Unless canceled, an annual subscription automatically renews through Apple for the period and price Apple shows. Manage or cancel it in your Apple Account settings at least 24 hours before renewal when Apple's rules require. Deleting Forty or deleting local data does not cancel a subscription. Follow the Apple subscription cancellation instructions.
Refunds
Billing and refund requests are handled by Apple under Apple's policies and applicable consumer law. Forty cannot issue an App Store refund directly. Use the Apple refund request instructions.
Restore Purchases and local progress
Restore Purchases asks Apple and RevenueCat to restore eligible premium access associated with your App Store account. Restore Purchases does not restore local program records. Forty has no account or cloud backup and does not sync your progress, notes, check-ins, or history between devices.
Intellectual property
Forty's software, design, original exercises, illustrations, branding, and compilation are owned by or licensed to Marcus CADASSE and protected by applicable law. Scripture excerpts identified as World English Bible come from the public-domain World English Bible; the source name is provided for clarity. No ownership is claimed over public-domain scripture.
Prohibited use
You may not use Forty unlawfully; interfere with its operation or security; evade purchase controls; scrape, copy, resell, or commercially exploit protected content; impersonate another person; introduce malicious code; or reverse engineer, decompile, or attempt to derive source code except to the limited extent applicable law expressly permits.
Availability, updates, and termination
Forty may correct, update, replace, suspend, or discontinue features to improve safety, comply with law or platform rules, address technical problems, or operate the service. Access may be suspended for material misuse. Where reasonably possible, changes will not remove statutory rights or paid access without an appropriate remedy required by law.
Disclaimers and limitation of liability
To the extent permitted by law, Forty is provided on an “as available” basis without a guarantee that it will be uninterrupted, error-free, or suitable for every individual. Personal growth depends on many factors outside the app's control.
To the extent permitted by law, Marcus CADASSE is not liable for indirect, incidental, special, consequential, or punitive losses arising from use of Forty. Nothing in these Terms excludes liability or remedies that cannot lawfully be excluded, including mandatory consumer rights and liability for intentional misconduct where applicable.
Governing law and consumer rights
These Terms are governed by French law, without depriving you of mandatory consumer protections that apply in your place of residence or use. Nothing here prevents you from using a competent court, regulator, or dispute process available under mandatory law.
Changes to these Terms
Forty may update these Terms when the app, purchases, vendors, or legal obligations change. The page will show the new effective date. Material changes will be communicated through an appropriate in-app or public notice when required.
